The following Terms of Use for the website www.atteli.com constitutes an agreement for the provision of electronic services between you and Atteli Sp. z o.o., with its registered office at 8 Szamocka Street, Warsaw, entered into the National Court Register maintained by the District Court for the capital city of Warsaw, XIV Economic Division, under number KRS 0000453428, with a fully paid-up share capital of PLN 5,000, NIP 5252548444, REGON 146563075.

The Terms of Use aim to outline the rules and conditions for using the Services, as well as the rights and obligations of Users. Please carefully review the contents before starting to use the Service.

§1 General Provisions

  1.  Definitions of terms used in the Terms of Use:
    1.1. Contact Form – an interactive form available on the Service that allows Users to directly contact Atteli;
    1.2. Consumer – a User who is a natural person making a legal transaction with an entrepreneur not directly related to their business or professional activity or a User who is a natural person entering into a contract directly related to their business activity, provided the contract indicates it is not of a professional nature based on the Central Registration and Information on Business activity regulations;
    1.3. Atteli – Atteli Sp. z o.o. with its registered office at 8 Szamocka Street, 01-748 Warsaw, entered into the National Court Register maintained by the District Court for the capital city of Warsaw, XIV Economic Division, under number KRS 0000453428, with a fully paid-up share capital of PLN 5,000, NIP 5252548444, REGON 146563075;
    1.4. Privacy Policy – the privacy policy available at https://atteli.com/en/privacy-policy/;
    1.5. Terms of Use – these Terms of Use;
    1.6. Service – the website available at www.atteli.com;
    1.7. Services – electronic services, as defined by the Act of July 18, 2002, on Providing Electronic Services (Journal of Laws of 2020, item 344) available on the Service, particularly the services described in §3 of the Terms of Use;
    1.8. User, You – the person using the Service;
  2.  All copyrights to the content provided on the Service, including rights to texts, photos, graphics, logos, or other elements of the Service, belong to Atteli.
  3. Users are prohibited from providing unlawful content, including content that infringes on the personal rights of third parties, incites racial, ethnic, or religious hatred, or violates generally accepted social norms.
  4. Any references on the Service to products, services, processes, or other information through trade names, trademarks, manufacturers, suppliers, or other designations do not constitute or imply endorsement, sponsorship, or recommendation by Atteli.

§2 Technical Requirements

  1.  To use the Service, you need an end device with internet access and a web browser such as Internet Explorer, Microsoft Edge, Google Chrome, Mozilla Firefox, Opera, or Safari in the current version. To use some functionalities of the Service, particularly the Contact Form, an active email account is also required.
  2.  Atteli will make every effort to ensure continuous and proper operation of the Service. However, Atteli reserves the right to:
    2.1. Manage technical breaks, i.e., temporarily disabling or limiting the functionality of the Service in whole or in part, particularly for maintenance or modernization purposes;
    2.2. Modify the Services and the operation of the Service.
  3.  Atteli is not liable for damages resulting from interruptions in Service delivery due to circumstances beyond Atteli’s control, such as force majeure.
  4.  The Service may contain links to other websites. Atteli does not guarantee the correctness of the information contained in these links or websites, and browsing them is at the User’s own risk.

§3 Services Provided on the Service

  1.  The Service offers free Services:
    1.1. Access to materials about Atteli’s activities and the offer of services, solutions, and products related to modern business applications, as well as sales and marketing technologies;
    1.2. Access to industry articles created by Atteli;
    1.3. Contact Form.
  2. When filling out the Contact Form, the User may voluntarily consent to receive marketing information electronically from Atteli or companies within the Netwise group.
  3. The User may cease using the Services (terminate the electronic service agreement) at any time by leaving the Service.

§4 Complaints

  1.  The User has the right to submit a complaint regarding the Services at any time.
  2. Complaints can be submitted:
    2.1. By sending correspondence to: 8 Szamocka Street, 01-748 Warsaw;
    2.2. Electronically, via: info@atteli.com; or
    2.3. Electronically through the Contact Form.
  3. The complaint should include the User’s identification (name, email address), a detailed description of the circumstances constituting the basis for the complaint, and the User’s request.
  4.  Atteli will address the complaint within 14 days from its receipt.
  5.  The response to the complaint will be sent to the email address provided by the User.

§5 Withdrawal from the Agreement

  1.  A Consumer who has entered into an electronic service agreement may withdraw from the agreement within 14 days of its conclusion without providing a reason and without incurring any costs. To meet the deadline, it is sufficient to send a statement before its expiry. The Consumer can submit the withdrawal statement, for example:
    1.1. By sending correspondence to: 8 Szamocka Street, 01-748 Warsaw;
    1.2. Electronically, via: info@atteli.com; or
    1.3. Electronically through the Contact Form.
  2.  The withdrawal statement can be submitted in any form. The Consumer may use the withdrawal statement template provided in Appendix 1 to the Terms of Use.
  3.  If the right to withdraw is exercised, the agreement is considered not concluded.

§6 Alternative Dispute Resolution

  1.  Consumers have the right to resolve disputes amicably.
  2. Details about alternative dispute resolution methods can be found on the website maintained by the President of the Office of Competition and Consumer Protection: https://polubowne.uokik.gov.pl/pytania-i-odpowiedzi,6,pl.html
    3. The President of the Office of Competition and Consumer Protection also operates a contact point which, among other things, provides assistance to consumers in matters related to alternative dispute resolution. Details are available at: https://uokik.gov.pl/pomoc-dla-konsumentow-instytucje.
    4. At http://ec.europa.eu/consumers/odr there is an online platform for resolving disputes between consumers and businesses at the EU level (ODR platform). The ODR platform is an interactive and multilingual website providing a comprehensive service point for consumers and businesses seeking to resolve disputes related to contractual obligations in e-commerce out of court (more information is available on the platform’s own page or on the website of the Office of Competition and Consumer Protection: https://polubowne.uokik.gov.pl/platforma-odr,161,pl.html).
    5. The above provisions are for informational purposes only and do not obligate the Consumer to use alternative dispute resolution methods. The Consumer may file a lawsuit in court according to general rules.

§7 Privacy

  1.  Atteli is the data controller of your personal data. Detailed principles of privacy protection and personal data processing are outlined in the Privacy Policy available at https://atteli.com/en/privacy-policy/
  2. The Privacy Policy forms an integral part of the Terms of Use.

§8 Final Provisions

  1. The Terms of Use come into effect on the date of publication on the Service and apply indefinitely.
  2.  The Terms of Use are available free of charge on the Service.
  3.  Atteli reserves the right to make changes to the Terms of Use in case of important reasons, particularly in the event of:
    3.1. Changes in legal regulations or changes in the interpretation of the law by courts, administrative bodies, or other institutions;
    3.2. Changes in the scope or conditions of Service provision or other Service functions;
    3.3. Changes in the way of using the Service due to technical or technological reasons;
    3.4. The need to update Atteli’s data;
    3.5. The need for editorial changes to the text.
     Atteli will inform about changes to the Terms of Use through a message on the Service along with the publication of the new Terms of Use text.
  4. For matters not regulated by these Terms of Use, generally applicable provisions of Polish law apply, particularly the Civil Code; the Act on Providing Electronic Services; the Consumer Rights Act; the Personal Data Protection Act.
